FSA Regulation
The Financial Services Authority (FSA) is the independent watchdog that regulates financial services and, with effect from 1st July 2009, they now regulate sale and rent back activities.
Companies offering a sale and rent back service without FSA authorisation are operating illegally and will be subject to prosecution and possible imprisonment.
Industry sources estimated that, in the middle of 2008, there were around 1,000 companies and individuals providing a sale and rent back service. Approximately 50 of these were believed to be medium sized companies like ourselves. By the end of September 2009 there were 44 companies permitted by the FSA to buy properties under the regulations.
On 30th June 2010 the FSA further tightened up the regulations for sale and rent back. Currently (9th July 2010) there are now only two companies legally permitted to provide the full sale and rent back service.
